Three States Fight Back Against Biden Student Loan Forgiveness

(TargetDailyNews.com) – The highest court in the land is being petitioned by the attorneys general of three Republican-leaning states to intervene in Biden’s student loan forgiveness scheme which is attempting to wipe out $500 billion of debt using public funds. The states issued a petition to the Supreme Court to lift an injunction allowing the implementation of the plan that was enacted by the 10th U.S. Circuit Court of Appeals.

Texas, Alaska, and South Carolina claim that Biden is attempting to circumvent a prior ruling that rejected his plan to forgive student loans. They called Biden’s policies “unlawful” in their filing and said it’s been unlawful this entire time. They also highlighted that Biden has already forgiven 12 digits worth of student loan debt using taxpayer funds.

Other courts in Kansas and Missouri rejected Biden’s claims and prevented some of the plans from being enacted in their states. Biden’s DOJ challenged the Kansas ruling in the 10th Circuit Court of Appeals which granted an injunction that allowed some reduction in monthly payments to begin, despite ongoing legal challenges.

That resulted in three states challenging the appeal before the SCOTUS. They’re specifically asking the court to block forgiveness for borrowers until the case is resolved on the merits. The current changes lower the monthly payments based on income and reduce the number of years someone has to pay consistently before being offered forgiveness. They also reduce the amount of interest that can accumulate on top of the original borrowed amount.

In 2022, the SCOTUS ruled against Biden’s plan to alleviate student loan debt, saying that the executive couldn’t forgive loans for folks making less than $125,000 per year or $250,000 per year per married couple. That ruling specifically stated (6-3) that the executive branch didn’t have the authority to wipe out student loan debt.

Former President Donald Trump called Biden’s plan to forgive student loan debt a “vile attack” and publicity stunt exclusively for the election. Biden’s administration has canceled $143 billion in student loan debt despite being rebuked by the SCOTUS.
